Frequently Asked Questions
How much annual leave do I accrue per week in Australia?▾
Full-time employees accrue 4 weeks of annual leave per year, which works out to approximately 2.923 hours per 38-hour week (or 152 hours per year). Part-time employees accrue the same rate proportionally based on their hours. Shift workers may be entitled to 5 weeks per year under some awards.
Do casuals get annual leave in Australia?▾
No — casual employees don't receive annual leave, personal leave, or notice of termination. Instead, they receive a casual loading of at least 25% on their base rate to compensate. However, casual employees who have worked regularly for 12+ months can request to convert to permanent employment under the Fair Work Act.
What is annual leave loading?▾
Annual leave loading is an additional 17.5% paid on top of your ordinary rate when you take annual leave. Not all employees are entitled to it — it depends on your award or enterprise agreement. If your award doesn't include it, you're entitled to your ordinary pay only. Check your award at fairwork.gov.au.
When can I take long service leave in Australia?▾
Long service leave eligibility varies by state. Most states require 7–10 years of continuous service with the same employer. In NSW and VIC, you can access LSL after 7 years (pro-rata). In QLD and WA, it's 10 years before you can access it, though some pro-rata entitlement may exist on termination after 7 years. Your employer must pay it out if employment ends after the qualifying period.
Is unused annual leave paid out when I resign?▾
Yes. If you resign, are dismissed, or are made redundant, your employer must pay out all accrued unused annual leave at your current ordinary rate of pay (plus annual leave loading if your award includes it). This payout is included in your final pay and taxed as normal income.
Disclaimer: Leave entitlements are based on the Fair Work Act National Employment Standards (NES). Individual awards, enterprise agreements, and state laws may differ. Always check your specific award or contact Fair Work Australia for advice.
