Frequently Asked Questions

Am I entitled to overtime in Australia?
Most award-covered employees are entitled to overtime when they work beyond their ordinary hours (usually 38 hours/week for full-time). However, some award-free employees or those on higher salaries may not receive overtime — their salary is considered to compensate for reasonable additional hours. Check your award, enterprise agreement or contract.
Is overtime taxed at a higher rate?
Overtime is taxed at your marginal rate like regular income — there's no special overtime tax. However, if earning overtime pushes your annual income into a higher tax bracket, you'll pay the higher rate on the income above the threshold. Your employer withholds PAYG based on your annualised earnings, so a week with heavy overtime may have more tax withheld — but this corrects at tax return time.
Can my employer make me work overtime?
Under the Fair Work Act, your employer can request reasonable overtime, but you can refuse unreasonable overtime requests. What's "reasonable" depends on factors like health and safety, your personal circumstances, the notice given, and your award or agreement. If you're consistently being required to work excessive hours, contact Fair Work Australia or your union.
What's the difference between overtime and a penalty rate?
Overtime is extra pay for working beyond your ordinary hours. Penalty rates are higher pay rates for working at certain times — like weekends, public holidays, or late nights — regardless of how many total hours you've worked that week. Both can apply simultaneously (e.g., working overtime on a Sunday might attract both a weekend penalty rate and overtime loadings, depending on your award).
Do casuals get overtime pay?
It depends on the award. Under some awards, casuals do receive overtime rates when they work beyond the ordinary hours specified in the award. However, casual employees already receive a 25% loading to compensate for missing entitlements. In some awards, the casual loading replaces overtime; in others, overtime is paid on top. Check your specific award on the Fair Work website.
